1. Acceptance of Terms
By downloading, installing, or using the StepToFit mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and StepToFit ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Account Registration
The App requires you to sign in with a Google account via Google Sign-In.
- You are responsible for maintaining the confidentiality of your Google account credentials.
- You are responsible for all activity that occurs under your account.
- You agree to notify us immediately at mayur@dnyantra.com if you suspect unauthorised access to your account.
- You may have only one account per person. Creating multiple accounts to gain an unfair advantage in competitions is prohibited.
4. Account Deletion
You may permanently delete your account at any time from Settings → Delete Account within the App. Deletion is immediate and irreversible. All your data stored in our systems will be permanently erased. See our Privacy Policy §5 for details.
5. Health Data & Apple HealthKit
The App integrates with Apple HealthKit to read your fitness data.
- Granting HealthKit access is optional. The App will function in a limited capacity without it, but step-tracking and leaderboard features will not be available.
- The App reads step count, walking/running distance, active energy burned, and flights climbed. No other health data types are accessed.
- Health data read from HealthKit is used solely to provide features within the App. It is never used for advertising or sold to third parties.
- You may revoke HealthKit access at any time via iOS Settings → Privacy & Security → Health → StepToFit.
6. Challenges & Blitz Events
6a. Fair Play
All step counts used in competitions must represent genuine physical activity. You agree not to:
- Use mechanical devices, shakers, or any automated means to artificially inflate step counts.
- Manipulate Apple Health data to submit false scores.
- Exploit bugs or glitches in the App or backend to gain an unfair advantage.
- Create multiple accounts to participate in the same event more than once.
The App includes an automated anti-cheat system. Submissions that exceed physiologically plausible step rates (e.g., over 150 steps per minute combined with negligible GPS distance movement) are flagged and may be excluded from rankings. We reserve the right to disqualify any participant found cheating.
6b. Challenge Leaderboards
When you join a challenge or Blitz event, your display name and step score are visible to other participants. By joining, you consent to this visibility. You may leave a challenge at any time from within the App.
6c. Invite Codes & QR Codes
Challenge invite codes and QR codes are for personal use. You may share them with friends and family. You may not use them for commercial purposes, spam, or to recruit participants under false pretences.
6d. Safety in Physical Activity
Physical challenges involve physical exertion. You accept full responsibility for your participation. Listen to your body. Stop immediately if you feel pain, dizziness, or discomfort. We are not liable for any injury sustained while using the App or participating in challenges.
7. FIT Certificate
The FIT Certificate is a non-binding, decorative PDF document that celebrates your yearly step achievement. It is:
- Generated based on data read from Apple HealthKit and is only as accurate as that source data.
- Not an official or legally recognised fitness certification, qualification, or credential.
- Not guaranteed to be accepted by any employer, insurer, or institution.
- Intended for personal celebration and sharing only.
8. User Conduct
You agree not to use the App to:
- Violate any applicable local, national, or international law or regulation.
- Harass, intimidate, or harm other users.
- Impersonate any person or entity, or falsely state your affiliation with any person or entity.
- Upload, transmit, or distribute any malicious code, viruses, or harmful content.
- Attempt to gain unauthorised access to our systems, servers, or databases.
- Scrape, crawl, or harvest data from our services without authorisation.
- Reverse engineer, decompile, or disassemble any part of the App.
9. Intellectual Property
All content, code, design, graphics, and other materials in the App are owned by or licensed to StepToFit and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
You retain ownership of any content you submit (e.g., your chosen display name). By submitting content, you grant us a non-exclusive, royalty-free licence to use it solely for the purpose of operating the App's features (e.g., displaying your name on a leaderboard).
10. Third-Party Services
The App uses Firebase (Google LLC) for backend services and Google Sign-In for authentication. Your use of these services is also subject to Google's Terms of Service and Privacy Policy. We are not responsible for the practices of these third-party services beyond what is described in our Privacy Policy.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure.
- Step counts, distances, or calorie figures are 100% accurate (they depend on Apple HealthKit data and device sensors).
- Leaderboard rankings will be available at all times.
- The App will be compatible with all iOS devices or future iOS versions.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STEPSAPP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless StepToFit and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users or our platform.
You may terminate your use of the App at any time by deleting the App from your device and deleting your account via Settings → Delete Account.
15. Governing Law
These Terms are governed by the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
Note: Replace this clause with the jurisdiction applicable to your company's registered location.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and StepToFit regarding the App and supersede all prior agreements.
